The following provisions (“Site Terms and Conditions”) govern your use of AcuteMedOnline. Using this site means you accept these Site Terms and Conditions and have had an opportunity to review and assent to AcuteMedOnline’s Privacy and Security Policy.  If you do not agree to these provisions and sent to AcuteMedOnline’s Privacy and Security Policy, you should immediately stop using and accessing AcuteMedOnline.
By proceeding, you acknowledge that you have accessed and had the opportunity to download or print a copy of the AcuteMedOnline’s Privacy and Security Policy, and you hereby consent to the use and disclosure of your protected information, including information generated through your use of AcuteMedOnline’s services, as described in the Privacy and Security Policy. This will include all of your protected health information generated during the provision of Services, including but not limited to treatment for mental health, drug and alcohol abuse, communicable diseases such as HIV/AIDS, developmental disabilities, genetic testing and other types of treatment received.
The services provided by AcuteMedOnline are not intended to take the place of your relationship with your existing primary care physician. They are intended only to supplement that relationship for your non-emergency medical needs. DO NOT USE THIS SITE FOR EMERGENCY MEDICAL NEEDS. If you experience a medical emergency, call 911 immediately.
As with any medical care provided to you, there are potential risks associated with the use of telemedicine. AcuteMedOnline believes that the likelihood of these risks materializing is very low. These risks may include, without limitation, the following: (i) deficiencies or failures of equipment and technology can result in delays in medical evaluation and consultation or treatment; (ii) security protocols can fail, causing a breach of privacy of personally identifiable protected health information; and (iii) a lack of access to complete medical records and/or inaccurate information provided by a patient may result in adverse drug interactions, allergic reactions or other negative outcomes. You understand that you may expect the anticipated benefits from the use of telemedicine, but that no results can be guaranteed or assured. You also understand that all information you provide to or receive from AcuteMedOnline will become part of your medical record and will be available to you by printing the summary from the visit. This information will be subject to further use and disclosure only in accordance with AcuteMedOnline’s Privacy and Seucrity Policy.
Once you choose to use AcuteMedOnline, you are responsible for (i) controlling the dissemination and use of activation codes and passwords; (ii) authorizing, monitoring and controlling access to and use of your user ID and password; and (iii) promptly informing AcuteMedOnline of any need to deactivate a password. You also agree to promptly notify AcuteMedOnline of any unauthorized use of your username, password or any other breach of security that you become aware of involving or relating to AcuteMedOnline’s site by emailing AcuteMedOnline at firstname.lastname@example.org addition, you agree to exit from your secure account at the end of each session. You agree that AcuteMedOnline will not be liable for any losses and/or damages arising from your failure to comply with this section, and you agree to indemnity AcuteMedOnline and hold it harmless from all such losses and damages, including claims arising from any such losses or damages.
If you or any person using your user ID and password causes damage to AcuteMedOnline’s service or any computer system, a loss of any data or an improper use or disclosure of a patient’s protected health information or AcuteMedOnline’s proprietary data, YOU AGREE TO BE SOLELY AND FULLY RESPONSIBLE for all such damage, loss and improper use and disclosure. You agree that AcuteMedOnline will not be liable for any losses or damages arising from the failure of any telecommunications infrastructure, including the internet, or for your misuse of any protected health information, advice, ideas, information, instructions or guidelines accessed through the service, and you agree to indemnity AcuteMedOnline and hold it harmless from all such losses and damages, including claims arising from any such losses or damages.
By using AcuteMedOnline, you represent and warrant that the medical history you provide on the site will have the most up-to-date and accurate information. Such information is vital for AcuteMedOnline to provide you with quality services that are appropriate for your individual needs and characteristics. If any information you provide to AcuteMedOnline becomes inaccurate, incomplete or otherwise false or misleading, you will immediately notify AcuteMedOnline by email at email@example.com.
You also represent and warrant that (i) you are at least eighteen (18) years of age, (ii) you are not presently receiving benefits from any governmental health care program, including Medicare and Medicaid, (iii) you have the legal ability and authority to enter into this Agreement with AcuteMedOnline, (iv) the information you have provided to AcuteMedOnline in your registration is accurate and complete, (v) you will comply with any and all laws applicable to your use of AcuteMedOnline, (vi) you will not interfere with a third party’s use of AcuteMedOnline, and (vii) you will not interfere with or disrupt the security measures used by AcuteMedOnline to protect its patients’ privacy or its proprietary information.
You also represent and warrant that you are currently physically located in the state you report/have reported to AcuteMedOnline as your current location. You acknowledge that your ability to access and use AcuteMedOnline is conditioned upon the truthfulness of this information and that the physicians you access are relying upon this information in order to interact with you. In the event that you inaccurately report your current location to AcuteMedOnline, you agree to indemnify AcuteMedOnline and its medical providers from any resulting damages, costs or claims as set forth below.
You agree to defend, indemnify and hold AcuteMedOnline, its officers, directors, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements (including without limitation reasonable attorney and accounting fees), resulting from or alleged to result from your violation of these Site Terms and Conditions. IN NO EVENT SHALL AcuteMedOnline BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM ANY LOSS OF USE, LOSS OF PROFITS, LITIGATION OR ANY OTHER PECUNIARY LOSS, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS WEBSITE OR THE PROVISION OF OR FAILURE TO MAKE AVAILABLE ANY SUCH PRODUCTS, GOODS OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You agree that AcuteMedOnline will not be liable to you or anyone else for any decision made or action taken based on use of this website.
If you violate these Site Terms and Conditions, your ability to use AcuteMedOnline will terminate. AcuteMedOnline may, in its sole discretion, terminate your access to its site, or any portion thereof, for any reason whatsoever without prior notice. These actions are in addition to any other right or remedy AcuteMedOnline may have available at law or in equity. You agreed that AcuteMedOnline shall not be liable to you or any third party for any such termination.
AcuteMedOnline has the right (but not the obligation) to refuse to provide access to its website to any person, agency or organization at any time, for any reason, in AcuteMedOnline’s sole discretion. AcuteMedOnline reserves the right to change, suspend, or discontinue all or part of the services offered through its website, temporarily or permanently, without prior notice, and you agree that AcuteMedOnlie will not be liable to you or anyone else for any such change, suspension or discontinuation.
AcuteMedOnline may contain links to third-party websites. Linked sites are not under the control of AcutemedOnline, and it is not responsible for the content of any linked site. Links are provided as a convenience only, and a link does not imply that AcuteMedOnline endorses, sponsors or is affiliated with the linked site. When you use a third-party web site that you have accessed through a link on AcuteMedOnline, you do so at your own risk and subject to the terms and conditions of use for the linked site; these Site Terms and Conditions do not apply to other websites. AcuteMedOnline disclaims any and all liability for any medical and health treatment information set forth on linked sites.
Other than information received directly by you from AcuteMedOnline’s medical providers, the content on the website should not be considered medical advice. AcuteMedOnline may post or provide links to general information resources that may be of interest to you (“Posted Materials”). Posted Materials are not to be used as medical diagnosis, treatment or advice. You should always rely upon appropriately qualified health care professionals for diagnosis and treatment, including information regarding which medications or treatment may be appropriate for you. None of the content on this website represents or warrants that any particular medication or treatment is safe, appropriate or effective for you, and, apart from its medical providers’ specific recommendations to you, AcuteMedOnline does not recommend or endorse any tests, physicians, medications, products or procedures.
These Site Terms and Conditions are governed by the laws of Oklahoma. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Site Terms and Conditions, which shall remain in full force and effect.
 AcuteMedOnline respects the privacy of the patients who rely upon it. We are happy to share AcuteMedOnline’s Privacy and Security Policy regarding the privacy and security of protected health information that is collected from you and how that information is used. AcuteMedOnline has developed all systems and manages the data for this site. All data is stored in encrypted format that meets or exceeds standards defined by the Health Information Portability and Acountability Act of 1996, as amended (“HIPAA”), and the requirements of Oklahoma law. All data transfer is executed using similar standards that meet or exceed the requirements of HIPAA and Oklahoma law, and no data is transferred to users that do not have specific data access keys.
The importance of security for all of your protected health information is of utmost concern to us. AcuteMedOnline provides secure transmission of your information from your PC to our servers. The protected health information you provide to AcuteMedOnline is stored in secure operation environments that are not available to the public. Your protected health information will be used exclusively and only for the specific reason for which you submitted it. Only those employees who need access to your information are allowed access, each having signed confidentiality agreements. Any employee who violates our privacy or security policies is subject to disciplinary action, including possible termination and civil and/or criminal prosecution.
AcuteMedOnline takes every reasonable precaution to maintain the privacy and security of your protected health information, including the use of encryption and passwords when appropriate. AcuteMedOnline is the sole owner of the information collected on its website and will not sell, share or lease this information to others. AcuteMedOnline never sells any customer lists or e-mail addresses, cookies or other data it receives from you.
To use AcuteMedOnline, you will need to provide us with an email address we may use to contact you. We will use email to send you important updates about AcuteMedOnline as well as notifications when information and documents are added that you should be aware of. We will also use email to send general information about the services available through AcuteMedOnline. In some instances, but not all, you will be able to opt out of receiving emails. AcuteMedOnline’s use of a cookie will never be linked to any of the personally identifiable information AcuteMedOnline receives from you. AcuteMedOnline will never use a cookie to retrieve additional information from your computer and, except as described below, will not use information transferred through Cookies for any promotional or marketing purposes or share such information with any third parties except as required by law.
AcuteMedOnline may share your protected health information with other individuals for treatment, payment and healthcare operations purposes. AcuteMedOnline may also share your protected health information upon receipt of a valid court order, upon receipt of a legally enforceable subpoena, upon receipt of your written authorization and in circumstances in which disclosure can prevent or reduce a serious threat to anyone’s health or safety, including reporting of suspected abuse, neglect or domestic violence.
